COVID-19 NJ-DOL Scenarios & Benefits Available

Popular question of the week:

I have been hearing from a few members that some of their employees don’t want to work because they don’t feel safe, even though the employer is supplying masks, gloves and disinfectant…they would rather collect the unemployment benefits.

Click here to view the document from the Department of Labor that clarifies each scenario and what benefits are available to them.  I also asked one of our attorney members, Mike Grohs from Saiber, if he could clarify on this topic.

“If the employee is unable to perform the work from home and is refusing to come to work solely out of fear of contracting the coronavirus, he/she would likely not be entitled to unemployment insurance and may not even be entitled to paid sick leave (again depending on the circumstances).  But, the employee may be able to use any available accrued paid time off but only if doing so is consistent with the company’s policy.   The answer may also vary depending on whether the employee is eligible for disability or family leave.

If any members are looking for legal advice on employment, insurance, contract or other matters impacted by COVID-19, please feel free to have them email me directly mgrohs@saiber.com.  If I cannot address the issue, I can put them in touch with another attorney at Saiber.  Please also feel free to invite members to visit Saiber’s COVID-19 Resource Center https://www.saiber.com/practices/coronavirus-covid-19”
